Terms of Service

1. Acceptance of Terms

By accessing or using the AlphaGlow AI platform ("Platform"), operated by AlphaGlow AI ("Company," "we," "us," or "our") at alphaglowai.com, you ("User," "you," or "your") agree to be bound by these Terms of Service ("Terms"). If you do not agree, you must immediately discontinue use of the Platform.

We reserve the right to update these Terms at any time. Continued use after changes constitutes acceptance. Material changes will be communicated via in-app notification or email.

2. Platform Description

AlphaGlow AI is an AI-powered wellness platform that provides personalized guided meditations, wellness journeys, health optimization programs, Digital Twin technology, creator-led content, and an AI wellness companion ("Nova"). The Platform uses artificial intelligence, including but not limited to large language models and avatar generation technology, to deliver personalized experiences.

The Platform includes the NSVX utility token, which is used for accessing features, participating in the creator economy, and earning rewards through platform engagement. Use of NSVX tokens is subject to the NSVX Token Disclaimer.

3. Eligibility

You must be at least 18 years of age (or the age of majority in your jurisdiction) to use the Platform. By creating an account, you represent and warrant that you meet this requirement and that all information you provide is accurate, current, and complete.

4. User Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must notify us immediately of any unauthorized access or security breach. We reserve the right to suspend or terminate accounts that violate these Terms.

5. User Content & Ownership

You retain full ownership of all content you create and upload to the Platform, including but not limited to text posts, images, videos, audio recordings, and meditation scripts ("User Content").

By posting User Content, you grant AlphaGlow AI a non-exclusive, worldwide, royalty-free license to host, display, distribute, and cache your User Content solely for the purpose of operating and improving the Platform. This license terminates when you delete your content or account, except for copies that exist in backups (which are purged within 30 days).

You represent that you have all rights necessary to grant this license and that your User Content does not infringe any third party's intellectual property, privacy, or other rights.

6. Creator Rights

Creators who publish wellness programs, meditations, or other content on the Platform retain full intellectual property rights to their original works. AlphaGlow AI does not claim ownership of Creator Content. Creators grant the Platform a license to display and distribute their content as described in the Creator Agreement.

Creators have the right to remove their content at any time. Upon removal, the Platform will cease distribution within a commercially reasonable timeframe (typically within 48 hours).

7. AI & Digital Twin Usage Terms

The Platform utilizes artificial intelligence, including AI-generated content, Digital Twin avatars, and voice synthesis technology. By using these features, you acknowledge and agree that:

  • AI-generated content (including Nova responses, meditations, and wellness insights) is produced by machine learning models and may not always be accurate, complete, or suitable for your specific circumstances.
  • Digital Twins are AI-powered representations and do not constitute the actual person they may visually or vocally resemble. They are provided for entertainment and wellness purposes only.
  • You will not use AI or Digital Twin features to create, distribute, or facilitate content that is harmful, misleading, defamatory, harassing, or illegal.
  • AI features may be modified, updated, or discontinued at any time without prior notice.

8. ZERO TOLERANCE: Digital Twin Identity Theft & Impersonation

AlphaGlow AI maintains an absolute zero-tolerance policy toward Digital Twin identity theft, unauthorized cloning, and impersonation. The following actions are expressly prohibited and constitute a material breach of these Terms:

  • Creating, training, or deploying a Digital Twin, AI avatar, voice clone, or deepfake of any person without their explicit, documented, written consent.
  • Using the Platform's AI or avatar technology to impersonate, mimic, or falsely represent any real individual, whether a public figure, creator, or private person.
  • Extracting, scraping, or reverse-engineering Digital Twin models, voice profiles, avatar data, or any AI training data from the Platform for the purpose of unauthorized reproduction.
  • Distributing or monetizing unauthorized Digital Twin content outside the Platform.
  • Using AI-generated likenesses to harass, defame, deceive, defraud, or manipulate any person.

VIOLATORS WILL BE PURSUED TO THE FULLEST EXTENT OF THE LAW.

Upon detection of any violation, AlphaGlow AI will: (a) immediately and permanently terminate the offending account without refund; (b) preserve all evidence of the violation; (c) report the violation to relevant law enforcement authorities; (d) cooperate fully with any criminal investigation; and (e) pursue all available civil remedies, including but not limited to injunctive relief, statutory damages, actual damages, and attorneys' fees. AlphaGlow AI reserves the right to seek damages of no less than $150,000 USD per violation, or the maximum amount permitted by applicable law.

If you become aware of any unauthorized Digital Twin usage or identity theft on or involving the Platform, report it immediately to legal@alphaglowai.com.

9. Health & Wellness Disclaimer

AlphaGlow AI is not a medical device, healthcare provider, or substitute for professional medical advice, diagnosis, or treatment. All wellness content, meditations, AI-generated health insights, and wellness programs are provided for informational and educational purposes only.

Always consult a qualified healthcare professional before beginning any wellness program, making changes to your health regimen, or if you have concerns about your physical or mental health. Never disregard professional medical advice or delay seeking treatment because of content accessed through the Platform.

In an emergency, contact your local emergency services immediately. The Platform is not equipped to handle medical emergencies.

10. Prohibited Conduct

You agree not to:

  • Use the Platform for any unlawful purpose or in violation of any applicable law.
  • Harass, abuse, threaten, or intimidate other users or creators.
  • Upload or distribute malware, viruses, or other harmful code.
  • Attempt to gain unauthorized access to other accounts or Platform systems.
  • Scrape, crawl, or otherwise extract data from the Platform without authorization.
  • Circumvent or interfere with security features or access controls.
  • Use the Platform to provide medical advice or represent yourself as a healthcare professional.
  • Post false, misleading, or deceptive content, including fabricated health claims.
  • Resell, sublicense, or commercially exploit Platform access without authorization.

11. Intellectual Property

The Platform, including its design, code, branding, logos, AI models, Digital Twin technology, the "Nova" character and persona, and all proprietary content, is the exclusive intellectual property of AlphaGlow AI and is protected by copyright, trademark, trade secret, and other intellectual property laws.

"AlphaGlow," "AlphaGlow AI," "Nova," "NovaCore," "NSVX," and related marks are trademarks of AlphaGlow AI. Unauthorized use of these marks is prohibited.

12. Third-Party Services

The Platform integrates with third-party services including, but not limited to, Anthropic (AI language models), HeyGen (avatar and voice synthesis), and Supabase (authentication and database). Your use of the Platform is also subject to the terms and policies of these third-party providers. AlphaGlow AI is not responsible for the practices or policies of third-party services.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ALPHAGLOW AI AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF THE PLATFORM.

IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO ALPHAGLOW AI IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED US DOLLARS ($100 USD).

14. Disclaimer of Warranties

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT AI-GENERATED CONTENT WILL BE ACCURATE OR RELIABLE.

15. Indemnification

You agree to indemnify, defend, and hold harmless AlphaGlow AI and its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the Platform; (b) your violation of these Terms; (c) your User Content; or (d) your violation of any rights of a third party.

16. Termination

We may suspend or terminate your access to the Platform at any time, with or without cause, and with or without notice. You may terminate your account at any time by contacting support@alphaglowai.com. Upon termination, your right to use the Platform ceases immediately. Sections 5, 8, 9, 11, 13, 14, 15, and 17 survive termination.

17. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved through binding arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules, except that either party may seek injunctive relief in any court of competent jurisdiction.
